Letter from the Labour Inspectorate
10.03.2010The Labour Inspectorate - Sofia wrote to Georgi Gradev today in response to his complaint of 27 January 2010 against the illegal decision rendered by the Arbitration Court of the Bulgarian Football Union in the case Coach Ivan Kyuchukov v/ Club Chernomoretz Balchik. In the cited unlawful decision of 18 September 2009, the BFU Arbitration Court has adjudicated on an employment-related dispute for which the BFU (organs) does not have jurisdiction.
According to Art. 360.1 of the Bulgarian Labour Code, only the civil court is competent to rule on an employment-related dispute - arbitration is explicitly forbidden by the law (cf. also Art. 19.1 of the Code of Civil Procedures).
According to the today's letter of the Labour Inspectorate - Sofia, the said BFU Arbitration Court Decision (and all other employment-related decisions passed by that organ) is NULL AND VOID! The Labour Inspectorate - Sofia has prescribed to the Chairman of the BFU Arbitration Court "to put and end to its vicious practice to adjudicate on employment-related disputes"! This further means that the BFU Arbitration Court is not competent to establish the financial consequences deriving from the termination of a contract between a club and a player or a coach, which the BFU is still doing against the law!
